If you start the recording then let them know you are recording I think that covers you legally in most places. So I would just start recording holding the phone up and let her know you are recording your interactions from now on.
Do this in a calm emotional state. Do not let her emotional state effect yours.
Depends on the state. We live in a "1 party consent" state so I can record any interaction which I'm a party of without their knowledge and without their expressed consent - just curious if there was a more discrete way to handle it without making it an obvious/smart phone "in their face" and potentially escalating the situation.
