The way my attorney has set up the settlement is that the property will become my asset and the deed will reflect this. We have no language in the settlement that I need to buy her out or even remove her name from the mortgage loan. So I get a personal loan to pay her the 50% equity we have in the home. Right now my guess is we might have $30,000 in equity which means I'll have to pay her $15,000.
