I knew it was no fault state and the child support was calculated solely from how much each make. However, I thought I read somewhere maintenance is rarely given unless there are specific circumstances.


I'm not a lawyer, but my understanding is that MOST judges use a formula to determine whether spousal support should be given and how much it should be. This formula is exclusively based on income potential and child care responsibility. In my case, my income is substantially higher than my W, so I will likely have to pay. So we could agree on a number based on the formula. Or go to a judge, where the judge COULD decide ANYTHING. But my understanding is that generally it isn't based on the morality or fault behind the divorce.
