Wait, Wonka, I'm not saying the house offer is low.

For our neighborhood, a two bedroom house with one bath and a few issues...well, we could get a bit more. I know he updated the bathroom.

But, MY point is...Smokey wants this house GONE GONE GONE.

If I present an obstacle, I wonder what he would do? We all know he doesn't want the court to make the final decision here...he has to be 100 times more terrified than I am about court. I mean he is going to get vilified.

Someone has made an offer and it's a good one which could go through quickly without any inspections. This would take the $700 mortgage payment off the table for Smokey. He knows he can't count on me to pay it. He HATES this mortgage payment.

You need to speak to the realtor and find out how much of a loss was taken. If he truly wants you to sign off on these papers, I would negotiate any and all expenses for repairs and cleaning of the house, as well as his tools be wiped off the slate. That's much more doable then the other items you want right now.

As for the other items, well, those can be negotiated during the hearing. He already knows what you want in those areas. They can be negotiated during the hearings, etc. coming up.


Sit quietly, the answers will reveal themselves when you least expect them to.
The past is gone, the present is a gift and you need to focus on today, allow the future to reveal itself when it is ready.

The realtor just texted me that there was no loss taken on the house.

Now, MIL was a realtor. The house is listed with the agency she used to work with. The realtor is a friend of hers.

So, chances are pretty good that this realtor will turn up as a witness regarding the condition of the house.

Can I ask the realtor, "What was the condition of the house when you first saw it?"

No! That's a no-no. Zip it. It could hurt you for it implies that you knew it wasn't in a good condition.

No, I wouldn't ask her because more than likely it was cleaned up before the realtor saw the home. Based on the photos that I saw, the house wasn't in bad condition. I did notice that they didn't post any photos of the bathrooms.

If there was no loss, then I would negotiate w/your xh about the slate being cleared on those tools and whatever the condition of the house was in w/respect to cleaning. Everyone normally cleans the homes before the realtors see them. As for the spackling, well a bucket of spackling doesn't cost much, and he didn't clean the carpets from what I can see, but I would be concerned about that space in the kitchen where something is missing and the wiring is sitting out. What was taken out of the home?

You can't hold up the sale of the home for very long or you'll lose the interested party, so whatever you are going to do, you need to do it soon, not necessarily today, but soon.
