The wills of your parents are completely irrelevant! Ask your attorney, but I don't see how any money you may or may not inherit in the distant future is legally relevant. Your parents could spend all their money or cut you out of their wills. And unless your state has very weird rules, I doubt your parents could be forced to comply with that request. People have a right to keep their wills private until they die, should they choose.

As for asking your mom for money...do you have a good explanation for why your income didn't cover your expenses? Can you show her your budget? Show her steps you are taking to reduce costs? She needs to see that you're not just living beyond your means and going to come back again next month.
Btw how can you afford counseling when you can't even pay your rent??

I do have one question and this is something else that may need to be factored into your budget. Won't you have to have your car inspect in the NY? If so, the mirror that your D20 broke will need to either be repaired or replaced.

You've got to sit down, create a spreadsheet and work up a budget. You have to stick to it until you get yourself out of the financial hole you are in right now. D20 may have to get a second job and help out financially until you are over the hump or she goes off to school. You can't have your car payment and rent lapse. You were sitting pretty good there for a bit and then all of sudden you are now in the hole. Do you get paid every week or bi-weekly?


Sit quietly, the answers will reveal themselves when you least expect them to.
The past is gone, the present is a gift and you need to focus on today, allow the future to reveal itself when it is ready.

I had to give the atty another $1000.

This just isn't worth it Job.

If his divorce wasn't in my face, I could earn more money writing and doing other things.

D20 wants to go back to school in Jan.

This is killing me. KILLING me. I already have enough on my plate and I'm consumed with worry about fucckin Smokey.

I'd rather him just be out of our lives. I can earn more money. Let him think he won.

All I fucckin wanted was my temp support.

My atty promised me $500 per month.

I just want to let go of the past and focus on my job. At this rate, I will lose the opportunity with the other paper. I WILL LOSE IT and that's why I came here in the first place.

I don't see Smokey caring one way or another about the kids.

Yes, it is worth it. You h is counting on you giving up and giving him whatever he wants. You want to be left alone and that's not going to happen until your divorce is finalized. If you remember, even when you lived in OH, you had a lot on your plate and he wasn't giving you much in the way of support, monetary or moral at the time. Divorce proceedings aren't easy, but you'll get there, but you have to toughen up, look at everything that is on your plate and dig in. Life is never easy and if it were, we would be living in the Garden of Eden.

You can do this. You are not someone who quits when the going gets tough. Dig in and get those questions answered and back to your lawyer. That would be one less thing you would have to deal with. You can do this. You just don't want to face the work right now and you will only do it if you are pushed and this is one time you have to do the responses. Show these quacks you can do it and get them in before your h. I know you can do this. One item on the list at a time. Don't look at the entire list and think you have to do them all today. Do one item, check it off and go to the next one. You've already accomplished quite a bit w/respect to D12. D20 is pretty much set to leave in January. You've got this, Heather. All you have to do is dig in and take it one step at a time.

You need to go on the offense to get him off your back. Right now you are on the defense and you feel out of control. I would ask your attorney as part of discovery to request Smokie submit for a drug test. This will be part of your case that he is an unfit parent. I suspect that if you can get your attorney to make this request, Smokie will run for the hills. Figure out what else you can do or ask for which will make him run and go after these. This will be fighting fire with fire, but it is probably the only way to get him to run.

I agree w/what Life Twists suggests. Since he said he had someone share the rent in the new place, I would request the name of the person and how long that person has been living there. Since he's requesting the wills of your parents, I would do the same for his. (If you want to go that route, although I do not believe you should have to provide the wills for your parents because it doesn't have a thing to do with the current day to day operations.)

The more you bring to light some of the things he's done, the quicker he may back down. Right now, he's going after you and making you look like the bad guy. The shoe should be on the other foot because he's the one that walked out first. You didn't abandon him or the children...he did.
