You didn't mention whether there is any equity in the house or not? That would change the picture if there was.
As for the divorce - it might not be such a great idea to go through a divorce right now, with H unemployed, you might have to pay HIM spousal support. But you should at least consult with an attorney and find out how to protect yourself from any liability for H's debts that he may be running up now.
Also, you only have 30 days from his termination to apply for COBRA coverage, so you need to get on it.
KML- I did say I was flipped, therefore, no equity. And as far as COBRA is considered, I wasn't on the plan, the boys were, so I will not be notified of COBRA rights and also won't be able to apply just for them. He being the subscriber to the policy, he would have to do. There is also the Medical Support order that governs the medical so, other factors are in play. I can't enroll them on my plan unless I can get a certificate of creditable coverage listing the termination date. I won't get that from the ex. And lastly Obama care. Well I applied once for my children only and the exchange found they had an active policy...I can only re-apply when they have three months or more of non-coverage. So, it's complicated...but I do have a call in to my broker friend who will help me with them. At least at this time I do have some cash-only plans in place for accident and hospital and both the boys are current on annual physicals. I so understand the urgency and am working on it. You would think, but I'm not sure I will. Earlier in the year they promised over and over again to send me stuff, ie duplicate cards, eob's, etc, but to no avail. They must have sent it all to the ex, even though I explained the situation over and over. I am not hid g my breathe, but will make a call.

Any chance you can rent the house to somebody for a little more than the payment? Is that a worthwhile risk to take? Might be worth the tax write off?
