I can't sleep. The order I've requested to force xh to sign the title for my refi is with the judge. He will make his decision in the morning. Xh filed a response declaration which is completely misleading. He stated I want him to sign a transfer of ownership which is false. My declaration specifically states that the property will continue to be held as it is now. He also states that he doesn't understand my sudden urgency to refinance. Who is he kidding? He has been pressuring me to refinance for two years, but I couldn't do it without a support order. As as soon as I got one I started the process. Unfortunately, because it is a temporary order my broker had a heck of a time finding a lender who would accept it. I had to jump through hoops to get this done. The lender is waiting to close.
I don't know why I am surprised and upset by the response. Xh and his attorney have been untruthful from the beginning and have deliberately attempted to mislead the court. Their current action just strengthens my case for sanctions against them.
I just pray the judge doesn't consider xh's response and makes his decision based on my declaration which is truthful. I need this loan to close. I haven't been getting my ducks in a row all this time to fail when it counts the most. I am trying so hard to be faithful.
