Could be, depends on where you lives. Squatters rights. In Georgia, tenants at will (or with no lease, month to month, etc) actually are entitled to more notice than those with a lease. I generally tell my clients that if they want that pesky relative, child, whomever, out of their house, they need to evict them.
I would definitely see an attorney about moving her out and keeping OM off the business/home property.
