Will you receive a definitive answer on custody tomorrow?
We will hear about temporary custody, visitation and support tomorrow. This is a big milestone for me. I am getting some last minute items together.

Here we go. Heading to the courthouse in about 20 minutes. Next time I am on this board, I will know if my babies will be heading back to California in the next couple of weeks to be in my care.
I pray that is the outcome.

Thank you everyone for the support. Unfortunately things still did not go my way. The mediator recommended that we have a custody evaluation done and our children remain with my X in the meantime.
I'm processing everything that happened today to determine my next move. I'm not sure anything will change after the evaluation given how much effort I put into this hearing. It is deflating.
I did get to talk to my X after the hearing as I had to give her some of our children's belongings. She is beautiful and I admit it was good to see her despite the circumstances. We rehashed the hearing and our relationship. Talked about our children, etc.
A couple of funny things, she commented on my hair and shoes. I was dressed to kill in my Italian suit.
Later we had some TM exchanges and the X mentioned that she should have asked me to take her to lunch. Here is the short exchange.
M: You wanted to have lunch with me? It must have been the hair. What can I say? I'm a good looking guy.
X: A bunch of smiles.
M: You are beautiful yourself. It was good to see you despite the circumstances. Have a safe flight.
X: Thank you(with a blushing sad face). I'm getting ready to board.
A few minutes later.
X: I must admit, you did look handsome today.
Before all this while meeting with the mediator, the mediator asked us if there was any chance for reconciliation. Before she could finish the question, my X said no.
Enough craziness for me in one day. I need to figure out what to do next.

We will have to retain one of the pshychogist that the court recommended, which will cost me another 6-8K. That is only half. My X will be responsible for the other half.
Then our our children, my X and myself will have to go through an evaluation over a period of time. This can include a house visit here and one to NM. It just seems crazy. The earliest I would get my kids back would be for the Christmas break.
My X asked me to consider backing off. I am torn. This might be the time for me to negotiate. I don't think she can handle the kids full-time during the school year, along with her ill mother.
My head is swimming.

That suks... I guess it's really hard to tell the bias of the court, the bias of the judge, and the circumstances which are circumstantially in her favour... ie. the kids at the time of the hearing were in the custody of their mom, in a different jurisdiction...
but... ianal... so who knows...
slice it any way you want, it has to be tough that the kids are not with you and so far away...
