STBX did get into saying that I was an absent husband/father and I showed no interest in caring for her or the kids. All I cared about was that we made enough money to pay the bills and didn't worry about her's or the kids emotional needs.
My guess. And only a guess.
The judge will put more weight towards the reality of the last several months over her "memory."
I would suggest, and I think this was brought up before, that this is your emphasis in your response.
Think about what really matters and what does not. Your W left her kids!!!
Who was there for them?

One thing I want to caution you on. And this is not from anything I have seen yet, just a thought. Don't get so caught up in "the fight" that you lose site of your goal. #1 goal here is what is best for the kids.
Maybe there is a compromise in there that is best for them. Maybe not. I have no idea. Just a thought. Be aware.

Wow, I just got hit by bomb #2. The judge has ordered that I send my kids to NM by tomorrow. All I can say I am shell shocked. I don't even know what to think.

Thanks fellas. I happened to be taking the kids to Chuck E Cheese's when I got the call. Talk about getting this difficult news and being at one of the most challenging places to hold myself together. I had to excuse myself a couple of times.
It does suckk, but I will live to fight another day. Our hearing has been moved up from Sept 13th to August 2nd, but of course her L is not available that week.....conveniently. I will use the time between now and then to put my case together.
KD, the order doesn't state the reason. The judge just signed it and added some comments about them starting school in NM.
I know that I need to start another thread, but I'm not quite up to it right now.
There is plenty to update. Thankfully my STBX agreed to giving me until tomorrow to send them.

ummm... And in this ruling, what was his explanation...?
I meant to say that my guess would be that he made his ruling based on the the tentative agreement we had in place. Even though it never got finalized or signed by me.
It was my intent to sign it up until the beginning of June. Plenty of things changed, specifically her support system to care of the kids. I will ask her for transparency on who will be caring for the kids while they are not with her as her mom is still in a rahabilitation center.
