I know in the past lots of people on these boards have advocated to spy on their spouses via computer to find out for sure if a spouse is cheating. Well just today on msnbc.com there is an article where a man is facing felony computer misuse for using his wifes computer and password to check her email.
What do you all think of this?

At this exact moment, I think I would rather be facing felony charges than feeling what I'm feeling right now!

Maybe adultery could be made into a felony too? I don't know, NTGR. I fought the urge to spy, but now I wish with all my heart I did install a key logger and cell phone spy software.

I think this case won't see the inside of a courtroom. It's a gross misuse of the statute in question. I'd be willing to be the prosecutor has a reason for pushing for charges.
Also this would presumably apply to any email account - adult kids, parents, brothers, sisters.
Snooping is bad for a host of reasons (but I understand necessary at times) I don't think the fear of a felony would stop anyone nor is it the best us of a courts resources.

I think its crazy....I found out my H was cheating through his emails....How can the courts even think about trying this case? If thats the case, in some states adultry is a crime....would he have the right to sue her???

There was a similiar case here in Texas...the Cheating Wife that was snooped upon lost the case. The betrayed husbands lawyer said he had a right to spy to protect himself from HIV and STD's and to protect the children from possible sexual molestation, and to protect the children from possible violence and abuse by the other man being inside of their home. All of these things mentioned have occured with cheating spouses in the past, so they are a real threat to safety.
