I did end up sending stbx a text on Friday night and I thought it was a good response. He never wrote back but at this point, I wasn't expecting him to at all and I'm fine w/ that.

I had a good weekend. I had class and got out a bit. I saw HG twice and was more vocal about what is going on in my D w/ him since he asked how long is it would be before my D went thru and I told him about how I have court in 2 weeks, how it shoulda been resolved last month but hit a snag and how I should get a D date at the upcoming hearing.

Ran into some old friends of mine from high school and they just got married 3 weeks ago. I am really happy for them and was surprised they hadn't already tied the knot. Seems they have been together forever.

2 weeks exactly. I am feeling... like it's just another stone I have to step on to get to the next one.

I wonder how this one will go...if he withdraws this motion again, I am seriously going to be disappointed. I hope that doesn't happen but I can't see him offering to settle w/ me beforehand. So..? I have no idea. What if he withdraws it again? It's just dragging everything out. Once that day happens then the judge can schedule/set up a D date, officially.

My L emailed me that stbx and his L have shown "no willingness to settle." Court in 1.5 week..

I love that he just expects me to sign over the house like nothing...

Advice, anyone?

Spoke to my L w ho said he requested that stbx provide us w/ his financial records, including the rent he gets on our home and his L has not provided anything. Again. Now they have requested I provide my financial records and my L wants me to do this.

How is ok for him to be suing ME for mortgage and yet he won't provide financial info and is requesting that I do??? I've stated ti before but my stbx makes really good $ and it's ridiculous he's going after me for the mortgage. I knwo that is a scare tatctic so I sign house to him but still it's so stupid. I signed his f@cking greencard earlier this year which was something I did of my own volition and he's acting like this? WTF.

My L said he could see D taking "no less than 3 months." That seems like a damn eternity!

I countered his motion w/ a request for temp. spousal support and the last time, he w/drew the motion/delayed it for 2 months. WTF?

Advice?? Bueller? LOL...

You sound strong to me. If there are no kids involved I think I would take my chances and go to court. How good is your L? Maybe get a new L,a real shark type L?

Isn't it amazing that he can sound all broken hearted etc in his texts but yet planning a full on warfare against you? They're two faced, back stabbing beings. The only language they understand is their own- so you have to fight fire with fire.

What has your L sent to them so far? why does he claim there has been no willingness to settle? I don't trust anyone, not even my own L because the longer the case drags out and goes into trial it's more money to them. So I'm curious there. Here you have to do a financial discovery/disclosure as part of the divorce process. Once that is done you try to settle, failing that you go to trial.

Not knowing about the laws where you are my first question is what is your L suggesting advising you? What's his take on the house? Here the way it works is that any mortgage payment I'm paying on the house is considered my sole share in the house. So any amount I'm paying will be credited to me in the division of the house. She may even owe money to me on it. All depends on the equity and state laws etc. However, signing the house over shouldn't be the main issue here, the house should be a part of the overall divorce settlement. So I would be saying 'no piece mealing' let's get the whole settlement drafted, agreed and filed. He wants the house fine but he can pay you in cash etc whatever you want. It's called bargaining and your L should be advising you on it. If he's not, don't feel too bad because most of them are worthless like I'm finding out in my case so you have to find a better lawyer.

Are you in an equitable distribution state? All assets and debt should be tallied between the two of you, then divided equally. Like IR said, you can't just look at the house on it's own - it is part of the deal.

I got the house. I also had to pay off all the marital debt (including the credit card that he used during the affair).
