Yes North Carolina has some of the strictest laws in the country, actually oral sex is still a crime against nature here. But to shed some more light on how it works here, if you can prove there where sexual relations and the OP knew that the spouse was still married, you have a pretty good case.

In my sitch, I have all these things, I have the actual hotel receipt where the OM paid for the room, and emails between him and my wife prior to the PA proving he was aware she was married. Plus the admission from my wife in our separation papers that the PA happened.

I could actually sue both my W and the OM for "Criminal Conversation" and "Alienation of Affection". Criminal Conversation is the PA and Alienation of Affection is the separation/divorce. You have to have both in order to sue.

Here is the kicker......there is 3 years statute of limitations. That means I have another 2 years to rain down imortal hell on this guy, and he has money. Have been advised that it would cost about $20K to sue.

In 2001 a local wrestling coach was awarded $1.4 million, and that is the same county as Fantasia's. Fantasia stands to lose everything.
