if someone enters my home and steals my property easily because my wife was emotionally distraught and forgot to lock the door does that make my wife liabel or should the burglar be the one brought up on charges?
I think the main problem why we can't have a law against violating marriages is because one of the spouses consents (akin to signing a contract while drunk in my opinion which is also void), but that's an oversimplification...

My guess is that many of the alienation of affection laws were repealed because of politicians mistresses having their ears and not wanting to be liable for interloping.
