You'd have to ask your attorney. The laws about recording are different by state; some are "one-party" states and some are "two-party," and some are altogether different.

In my state (FL), my atty told me they were inadmissible, but I CERTAINLY was able to use them to:

a) gather useful intel;

b) help me make a determination about whether or not I should go for primary custody of our sons;

c) bluff my wife, and get her to "come clean" and start telling the truth to our adult daughters, and to her parents, and to ME, and to stop throwing me under the bus to these people.

There are exception to this (one example would be where there are children in the home; some jurisdictions allow you to monitor the safety of your own children, if you have reasonable cause to believe there may be emotional or physical abuse).

Most laws are STATE laws in this area, and he'd be wise to check with his atty as to what his state is.
