Standard stuff. Ask for more than you're willing to settle for. Take it in stride. Let your lawyer handle it. That's why you hired such a good one, remember?

And this is VERY important - don't discuss it with her. If she baits you, tell her you're not going to discuss it with her, have her lawyer contact yours.

L's go for everything up front. Now you counter with a lowball offer and back and forth until you come to an agreement.

What's the rush? Don't you have 30 days to respond? Use them.

I want to see him so I can stop hyperventilating. I will be slow with the counter.

Really, I don't care about the CC debt. I want joint custody and a lower bi-weekly payment. I'll just declare bankruptcy on the credit cards if I have to.

I did not and will not call W. I've talked to my aunt, my sister and a friend in Virginia so I don't call her.

I need some reassurance. Anyone have examples of the differences between what was initially asked for and what actually happened?

My X filed for custody stating that he was the better parent because of my "mental issues." (I was taking anti-depressant/anxiety medication, which amazingly I no longer needed after he left.) He did it to intimidate me into agreeing to his ridiculous proposal. My lawyer laughed. I went to a 6 hour psych evaluation that proved I was not only mentally stable but also highly intelligent. He paid $750 for the evaluation but never got to see it because he settled before court. I really think he thought I would be afraid to be evaluated and would give in to his demands. In that game of chicken he lost.

BND, you also are the mom. I know courts still lean towards moms.

The key CTH is that you have proof that you have been with the girls and never once wanted to have less. Just relax talk to the lawyer and counter higher than you want so there is some negotiation room. I think it is rediculous for you to pay child support and 1/2 child care, in IN child care is part of child support or factored in.

Go for what you feel is fair.

What I feel is fair is to have $1,000 of my check left. I can make it on that. That's what we basically agreed to when we met in February before she got spooked and hired this attorney.

If I can get to that level I should be able to figure ways around other stuff.

The credit card stuff really isn't that big of a deal -- I'm mentally prepared for bankruptcy -- but will stick in my side. I begged, pleaded with her to stop spending and didn't man up until we hit $15,000 in debt.

It's ultimately my fault though because I applied for it and thought we could handle it.

Chickens coming home to roost.

How did they come up with that figure?
In CA, there are standard calculators - is it the same way there?
What did her L use for your income, her income, the % time spent with each parent, etc.?
Gotta go - will check in
