only thing to do now is ride it out and see
if H proceeds or you file, you may achieve more closure
if H balks and needs more time, you may have to call in patiernce to see what happens
from most of these posts, these mlcers appear to bew gone a very long time and 3-4 years doesnt seem like enough
so again the choice will most likely be with you if you want to push D along or wait longer
