IRMA, I can tell you exactly what the Judge has in mind. The child still has to eat, even if he has no job. The child must have clothing, even if he has no job. The child must go to school, even if he has no job. The child still needs necessities, even if he has no job. In short, the court will require him to pay a certain amount even if he doesn't have a job. It is HIS RESPONSIBILITY to give you the money that the child needs. If he doen't pay you, he goes to jail, short and sweet. Texas has a reputation for not being tolerant when it comes to legal matters. I think you have an obligation to your child to do this. If you stand or don't stand, that is between you and your H. Care of your child and him doing his share is for your child. If you don't secure his obligation, that is x amount of dollars your child doesn't have. MLC or not, job or not, kids have to be provided for and if he refuses, he DESERVES to go to jail.
