Wow DCBHM, how interesting to find a book written by your judge, that ought to give you a pretty good idea of what to expect! It sounds like you are doing well, and I agree that letting the L handle things should do a lot for your PMA, better figure out a hobby to take up your newfound free time!

Yeah I need to figure out something besides drinking and steak... bartender is cute though... smile

Yeah I've got that b.s. hearing tomorrow. Should backfire on W's attorney though if things go as I planned.

Hearing went fine.

GAL motion is going to be denied according to the Judge since there are no abuse/abandonment/neglect allegations in regard to D1.

Mediation motion may/may not be granted, but the Judge made clear he was going to make W pay 100% for mediation regardless.

Psychological evaluation of me, he may/may not grant it since W has to pay for it but he did not seem that happy that his prior order wasn't followed. He didn't even raise his eyebrows at the 'abuse' and 'rape' allegations W's attorney made.

"So you are telling me that I ordered this back in May, and it hasn't even been started yet?"

My prior attorney came in just to notify the Judge that I was being represented by the new guy. The new guy has known the Judge for > 20 years at this point and in fact they were chatting each other up before he knew he was representing me now.

W's attorney looked a little flustered, and my previous attorney and her whispered quickly back and forth. Something may have been going on there. In any event, going forward we have a good plan. Much more comfortable now.

I did miss out on seeing D1 this morning. frown

D1 was doing well this morning. She had walked out of her pants because they were too big on her. smile

I stayed for about 30 minutes and spoke with the daycare worker for a bit. I got down on my knee and told D1 to give me a hug. When I told her "bye" she went "UHUH" and buried her head into my shoulder and started grabbing hold of me. She was really clingy this morning, and when I handed her to the daycare worker she started crying and reaching out for me. The worker told her she could wave to me out the window.

When I walked outside and passed by the window she started throwing a fit again. It was sad. frown

I really like the Judge though. First thing he asked when W's attorney mentioned 'rape' was "So how did her evaluation turn out?"

Then it went downhill for them after it came out they hadn't done it. Even if W 'wins' what she was asking for, she ends up getting charged $2000+ for a fruitless endeavor.

I'm waiting with anticipation the Judge's order...

I really like this Judge. He has been doing this long enough to notice when things are going downhill. He has an excellent sense of humor as well.

It probably doesn't take long for him to parse: "He raped her!" and "He should be forced to mediate!" into "We don't have a case!"

I don't think she thought her cunning plan all the way through... she was trying to argue I wanted mediation and that she could prove it - even though I was sitting there saying "no."

Mental gymnastics going into this case.

D1 was doing well this morning. She saw me through the window when I walked by and started fussing until I came around to see her. She grinned and got me to hold her for a while. I was able to sneak out without her throwing a fit as well which is nice.

I'm going to be starting a new thread shortly to consolidate a timeline, etc. and focus specifically on what is now known in the opening post in a summary.

THE JUDGES ORDER

Anyway, thus ends our latest engagement with a really sweet letter from W's attorney to my new attorney discussing her strong desire to get my wife's evaluation done a.s.a.p.

Yeah I'm sure she is on board now.

Her motion for a psych exam of me was denied outright.
Her motion for an attorney to be appointed to represent my daughter was denied outright.
Her motion for mediation (i.e. settling out of court) was postponed indefinitely but she has to pay for it 100% if it comes up again.

So I win all around. The only one that concerned me was the psych exam of me - not because I'm crazy but because it would have delayed things again.
