In a word.......YES! Of course, I think VA law is "equitable distribution of assets", not equal. I know you aren't looking at D as an option, but this is marital property and if he has an ounce of honesty in him, he wouldn't withold proceeds from the sale of a major item from the family.
Not sure how you bring this up to him though.
And that's the rub. He did not talk to me before listing it this time, he just went ahead and did it. Virginia is equitable distribution. I can see his head spinning already at having to give me half of whatever he sells it for. Oh, and I have physical possession the title, not him. It came in the mail while he was gone.
