An interesting article I just read, listing some pro's and con's, and just interesting overall reading:

Interesting topic. One could certainly argue that adultery is more destructive to society, and causes far more pain and anguish, than many petty crimes.

I am all in favor of these laws. Some states still have them on the books, but very few do. I disagree with removing them. People have used the argument that marriage is not a public issue. HHHMMM well,what about all the children of divorce that end up on public assistance due to the significant change in their circumstances, what about the expenses involved in getting mental health care for not only the LBS but the children as they cope with outright rejection from someone who promised to always be there.

Whether you look at it from a secular or sacred viewpoint, a marriage is a contract, yet there is no real penalty for breaching the contract. Third part interference is dealt with severely in contract law, why should it not be dealt with the same way when a marriage is destroyed by outside interference. Sure, yes, it does take two to tango in adultery, but the reality is, the WAS cannot tango if he does not have a willing partner.

Punitive? So what. Look at what the families stand to lose in the divorce. An LBS deserves to recover all that they stand to lose because of interference from an outside source, just like any other contract.

At first, reading the article I thought nawwwww, that's going to far to force someone to love you. But in hindsight I think there should be some sort of legal ramification for breaking a marital contract. In my sitch, my H often talks about not wanting OW to take him to court for child support () so he can't walk (excuse yes, but still some legal ramification) but with our M, he feels he can walk away and as he says give me everything and not look back. He thinks that since he wants to start over and he doesn't want anything, there are no consequences. I need some JUSTICE!!!

I think these type laws would be a good way to scare off an OP which would aid in the marriage staying in tact.

What I would like to see more often is, if a spouse commits infidelity, there should be NO spousal support. In a lot of states, including mine, adultery has no bearing on spousal support.

So my W can have an affair with OM, divorce me, take half my retirement and half my 401k, a large percentage of my wages and then continue her A and as long as she doesn't move in with OM or marry him, I'm stuck paying spousal support for x number of years.

And that I have a problem with.

Same thing in my state (FL), too. It's unconscionable.

Interesting article but unenforceable. Adultery to me is horrifying and it is the worst pain you can experience, but it is almost encouraged in films, internet, TV everywhere. Tired of watching films that are comedies and it is about cheating.

What better laws they should have is more wait period for divorces. In my state there is no waiting period and you could be divorced in as little as 31 days. Mandatory counseling for both parties together. No spousal support for the party that carries on the affair. Maybe it would made people more accountable knowing they will get nothing and put a little fear into them pre-A.

In the Catholic religion Adultery is considered a mortal sin right along with murder. It destroys and kills families.

Oh, I wasn't clear enough, Puppy??

I had this debate a couple years ago at school, little did I know how much more solidified my position would become in such a short time. I had, at one point, researched how to sue the OW in my sitch. She's a single mom, two older kids, in her 50s--I wonder how much my DH is worth to her??
