the year stbxd left he lived elsewhere and had another address, by mutual consent we filed M to get more money back, the IRS didn't care, for all they know he was at address due to work or illness or what have you, we never had to explain anything. If you are in good terms and agree to split (hopefully) the money you get back there shouldnt' be a problem about filing just the way you always did.
