I just got notification that ex filed bankruptcy. I haven't read it all over yet but pretty much leaves me without options, unless I get really lucky and win some money or something like that. Just one more thing to show me that I don't know this person.

Crap! Kat, I'm so sorry!!! Will this affect you worse b/c you didn't file before him?? I know you'd been thinking about it, but he sure didn't waste any time!!! (((((Kat)))))

I am not really sure. The lawyer I talked to wants me to try and hold out until I can file my taxes and get my return back. Then spend that I guess but they don't want me to pay the bills he is responsible for because that is throwing my money away and I really can't afford all of it. He obviously doesn't want it to get to the point where my home is in question so he doesn't want me to wait much longer than early February. I just hate the idea of it. It is killing me.

do what you have to do; BK is not the end of the world. If you can get your tax return and use it on legitimate expenses; you won't forfeit it in a tax return. If you file BK before you get your tax return, the trustee gets your return. You probably knew that already.

I agree with that 100%. I'm glad it sounds like you've gotten good advice.

It's my understanding that family court judges do NOT look kindly on bankruptcy actions -- even legitimate ones. That they are vary wary of one spouse playing shenanigans with another.

What does your atty say about this??

I know my divorce L foresaw this and thought it best to let him take me down with him. By the time he is done paying me alimony my credit should be back up. Bankruptcy L thinks if I file it will get rid of him as a pain in my financial behind. He won't have any buttons to push anymore. The thing that gets me is now of course I am stuck with about 80% of the debt and he is only having to pay like $62 a month for up to 5 years. Don't totally understand all the paperwork but give me a break!! He is responsible for more than that and he will be forcing me in to bankruptcy too!!! What a creep! I will have to do more checking on this on Monday, boy my boss must really like me to put up with all the stuff I am dealing with.

I know Ls have their own specialties, criminal or D or bankruptcy or whatever so wonder if that was great advice. Did the bankruptcy L say what to do if your H filed first??? Karen

He was just sort of implying it would be a wash because he had to file a Chapter 13 which is a repayment but I could do a chapter 7 and get rid of the rest. Crazy thinking but I still think he should somehow have to be responsible for what the court said he was responsible for.

But you know the court thought we should file B anyway because of our debt. I just want to get this all behind me. It is wearing me out.

I'm sorry. Have you had problems sleeping lately too b/c of the stress? I had that last night. I'm starting to get stressed with our first hearing Wed. am. I'm thinking when I read my H's email today that he seemed a little stressed out maybe too, although maybe that's just wishful thinking!!! \:\) Is your X still in la-la land??? Karen
