Update on me...

I took the day off as I had to be in court over the situation w/ the dogs. We argued our points to the judge and he denied the motion to have it dismissed, but he was very clear that the city will have to find a vet who can definitely say w/ no uncertainty that the dogs were in trouble. Even my vet said he couldn't make that determination w/out a rectal thermometer to take their temperatures at the time.

So, I'm still reliving this nightmare of an action when I had a massive brain fart earlier this year and I'm just hoping it can be resolved in my favor. We have a bench trial in this case set for Nov. 3rd and my L is thinking things went very well for us this morning. The chances of a vet being able to do this is very slim, so that is good.

We also talked about doing a deferred prosecution where this is tabeled for a year and then destroyed if my behavior is good. That would be an excellent option for me b/c even though I felt good that the judge was saying things look good for us to prevail, I'd rather not take that chance as it may screw w/ my ability to get re-licensed as an educator. So, that is a cleared hurdle for now w/ more to come on this later.

As for contact w/ W, she sent an e-mail today asking when I'd like to see D this weekend as D has a "party" w/ all her old friends from her original daycare.

I told W that I understand she wants weekend time w/ D, which is why I agreed to last weekend. However, since I can only see her on the weekends until the house sells, I want to have more than 24 hours w/ her so I'd like to get her from school on Friday and drop her off Sunday at 5 pm. We'll wait and see the response to this one.

Finally, the parenting evaluator at last called and spoke w/ my C and asked him some general questions about me. My C and I discussed this yesterday and the overall impression my C received was quite positive on my behalf. My C said it was encouraging, so I'm very stoked about that. This could mean a favorable ruling for me concerning custody of my D.

Now will come the hard part as I'm still stuck here in this house trying to get it sold. We'll have another open house this Saturday while I take D to the party at Chuck E. Cheese and hopefuly we'll get someone to like it enough to make us an offer we can live with. Due to the market, we'll most likely will need to have someone who has been looking for a while and knows what is available before we'll get a serious bite. We had someone that fit that description come through last Saturday and we're waiting to get the buyers back in town as they have been narrowing down their list. I'm hoping we've made their final cut.

So, that's my story. I'm going to film a commercial for Ashley Furniture this afternoon, so my day off from work will actually be profitable for me. If only they'd cut the checks right away as cash flow and I aren't getting along too well w/ me holding the house up on my own.

Talk to you all soon.
