Maybe trying something different before going the legal route would be worth pursuing.
I think it's Puppydogtails thread that has some different suggestions on getting a sitch out of cake-eating-land. There doesn't seem to be much of a reason for your W to change anything soon, she seems very comfortable with the way they are.
After your trip, might be time to shake things up? Much easier to do when you've reached the point you have.
