Can anyone help me with this.

H filed D papers about 2 weeks ago. He didn't want to file for a legal separation and said in the D papers that the D was mutual. It's not mutual. I don't want a D I wanted a legal sep. I know that all countries, states and provinces are different but in general what happens if I refuse the papers or to sign them?

I dont know about Venezuela, but in my state, you get served, or as I did it, I gave my W the papers (petition) and she had 10 days to sign receipt (acceptance), otherwise, I would have her served by an officer of the law at her work. Then after you have the accepted the papers, you have 30 days to file a response otherwise what was asked for in the petition is defaulted by the court. My L told me that the court hardly every does the default if 30 days expire.

Once you get your papers, you need to see an L.

Thanks Kerry, I assume most places are similar with the D process.

I guess I'll have no choice put to sign the papers. Oh well this sucks.

Just dont sign the papers if your signing means you are agreeing to their content. A lawyer can give you more details of the steps for your jurisdiction.

Right. I can't believe what he says are in the papers/document I'll need legal advice to clarify everything. I trust H but still need to know everything possible.

I am going to wait for the papers. His sister is a L here and 3 years ago when we had some problems he told me he was going to get his sister to file for him. When I asked her then about documents she had no idea what I was talking about. So like they say believe nothing of what the say right? I'll wait to get the papers and when/if I do I'll ask a friend who's a L to look at them for me.

I can't very well see a L about my options if I don't know what he's filed. He says he wants me to keep everything and he won't fight for custody of D. He just wants us to get along and do whats right. lets see if that is what he filed.
