I also wanted to mention - the reason you want two separate documents is that you DO NOT want a new settlement that says - in the new settlement that it replaces any old settlement.
That is what I would do if I was H's attorney. That is why you need to manipulate H to void the old settlement before he has time to prepare the new settlement.
