Maybe this whole talk of wanting half of the house is just her way to get you to act. I think it might be.
I have no doubt about that too. She is using the ace card here & I know that my friend. The OM has his own house that is paid for, no mortage on that. He has a very good paid job, so does the W, between them they make the debt look quite small. Basically W has thrown the teddy on the floor, but I have a bigger teddy & it's on the floor too.

Again I agree mate, there is no doubt that her head is messed. I have known all along that the friend & her brother (OM) have had a big part in this too. Again, I sat with hope that I would last out long enough to still care & be there for her if the crap hits the fan.
Part of me did not want to file for adultery against my W because, I really do love her & did not want that put to her name. I would have preferd her to file against me, even if that ment untruths being told. To know that she would see me with nowhere to go just made me see that I would be a very big fool indeed.
I'll continue to post here, I don't think i'm going away just yet. The main difference will be talk about the D rather than the hope of saving this mess.

I've been to the mortgage people today to try & sort something out regarding the cash that W is wanting from the equity on the house. Anyway there is no way I can take out the extra to give her half of the equity. For my earnings I am already very close the max that I could borrow anyway. However, I can borrow a little more but I have to remortgage the property & to keep the payments what they are now I have to take a 40 year payment plan lol, can you believe that? 40 bloody years....
Well I have no option because as I knew, it costs more to rent a property than what I will be paying on this place..Secondly, I could'nt even use my equity towards a new home because no one will lend me enough money to buy anything, as the house prices are so high now. Basically I would have £25,000 & could borrow a max of £50,000. House prices here are £90,000 min...Is'nt the UK great?
Also, I got a txt message from W regarding my call last night, I told her I was filing asap if D is what she wants, of course she said it is. I did ask her if she wanted to come talk about getting it sorted out but did'nt really get an answer..Anyway she sent a txt message saying she does not want to come & talk about it as we'll both get upset???..Upset lol..I don't think so, i'm done with that crap...I sent a txt back stating that I understand her not wanting to come talk, but I had no intesion of talking about us. Only in the terms of how we can get the D sorted out asap & as easy as possible...I did'nt get a message back.
If the L tells you she can't force a sale, and you don't want to move. Tell her no. And in that case, you may not want to file (because that may be what triggers a sale).

As it is, she is legally entitled to half of the equity. The courts would decide if she is entitled to more or all, but thats in extreme circumstances. She can't personally force the sale, however the court would during the divorce proceedings.
I called W to let her know the outcome of my trip to the mortgage lenders today..I told her I just can't get that sort of money & told her the max that I could have. Suprise suprise, that is not enough for her & I have to now look into selling my home.

Frankly, unless she has the balls to file herself (and she hasn't so far), you have to accept that you are also bringing this on yourself (at least in part), by throwing in the towel and filing. It is your right to do that, but recognize it for what it is.

I have valuers coming next week to, value the property etc...I have told my W this & told her that she too can stand here & witness the total end to everything we have...She asked me what I was going to do when the house was sold, meaning my living arrangements..I did remain carm & polite, but what the hell does she think. Unless house's begin falling out of my butt, I guess it's the sofa at my mothers.
On the positive side of things, I will have 25 grand to have fun with. I'll also be alot better off financially as to keep this place as it is now, takes 3/4 of my monthly income. The money I have left just about feeds me & thats about it.
Oh by the way Nom, get here quick sharp if you want to visit...My mothers sofa is not big enough for two lol
