When divorce lawyers take on a case, they often describe the settlement phase as similiar to dissolving an LLC. Suppose you and your business partner decided to split up the company due to breach of contract. Well, the assets and liabilities would be divided up.
The divorce laws in most states are very similar to the laws used to divide up companies. The part that divorce laws DO NOT TAKE INTO ACCOUNT IS ONE OF THE MARRIAGE PARTNERS HAS IN FACT BREACHED THE CONTRACT. No Fault divorce is simply a way for attorneys to charge $300/hour filing out boiler-plate forms and mailing $30 letters to everyone involved.
The Offending Party should realize some consequence for violating the contract, but folks that ain't gonna happen.
