Don't know about where you are but here the answer is yes. I have the right to say who gets be be in my house or not. I would expect the same in any civilized society otherwise there would be anarchy.

It is scary and moving back takes some bravery but do it. If anything it sends a really strong signal to your W. Think about this. That is YOUR house and where are you? Who's having the A? Who wants a D?
