Why are YOU moving out? I tried to re-read your thread to see if he owned the house. But even if he did own before the marriage, the court must decide who gets what marital property and if there is pre-marital property. Then and only then you you must leave. Before that happens no one can kick you out.
If it's both your home, then you may be in my sitch where both L's told my W and I to never leave because it looks bad for the person leaving behind the kids. So I sleep next to the W I am D'ing.
